In a follow up to your expressed concerns above and below:
I first want to thank you for your continued interest in joining as a contracted artist.
Your concerns are shared I am sure by other members of our network for SOGAC.
I regret that we can not accept your desired changes to our artist agreement.
I hope my answers here give a clearer understanding to you and all members.
1. Our artist agreement requires 10 years for many reasons.
It is well established that most new business's do not pass the test to become profitable
in the first 2 years .
Our 10 year agreement shows potential retail outlets and distribution companies that we
can assure that our product line will be there so they can invest with confidence to build
a product line for there businesses that can be reordered into the future.
2. This is already in our agreement with our artist.
3. It is also already understood and agreed to that "The ownership of copyright should remain
mine ( belongs to artist ) not Sabrinas - on all past and future works (paragraph B)"
Sabrina is only given rights for the use of artist works without restriction during terms of
our artist agreement. (b) prepared by ARTIST in the performance of services under
this Agreement include material subject to copyright protection, such materials " that "
have been "specially" commissioned by SABRINA
7. CONFIDENTIALITY AND OWNERSHIP
(a) ARTIST recognizes and acknowledges that SABRINA possesses certain confidential
Information that constitutes a valuable, special, and unique asset. As used herein,
the term “confidential information” includes all information and materials belonging
to, used by, or in the possession of SABRINA relating to its products, processes, services,
technology, inventions, parents, ideas, contracts, financial information developments,
business strategies, pricing, current and prospective customers, marketing plans, and
trade secrets of every kind and character, but shall not include (1) information that
was already within the public domain at the time the information is acquired by SABRINA
Or (2) information that subsequently becomes public through no act or omission of ARTIST.
ARTIST agrees that all of the confidential information is and shall continue to be the
exclusive property of SABRINA, whether or not prepared in whole or in part by ARTIST and
Whether or not disclosed, or entrusted to Artist's custody. ARTIST agrees that ARTIST
shall not, at any time following the execution of this Agreement, use or disclose in any
Manner any confidential information of SABRINA.
(b) To the extent any inventions, technologies, reports, memoranda, studies, writings,
articles, plans designs, specifications, exhibits, software code, or other materials
prepared by ARTIST in the performance of services under this Agreement
include material subject to copyright protection, such materials have been
specially commissioned by SABRINA and they shall be deemed “work for
hire" as such term is defined under US copy-right law.
To the extent any such materials do not quality as work for hire under applicable
law, and to the extent they include material subject to copyright, patent, trade secret, or
other proprietary rights protection, ARTIST hereby irrevocably and exclusively assigns to
SABRINA, its successors, and assigns all rights title and interest in and to all such
Materials. To the extent any of Artist's rights in the same, including without limitation
any moral rights, are not subject to assignment hereunder, ARTIST hereby irrevocably and
Unconditionally waives all enforcement of such rights. ARTIST shall execute and deliver
such instruments and take such other action as may be required to carry out and confirm
The assignments contemplated by this paragraph and the remainder of this Agreement. All
documents, magnetically or optically encoded media, and other tangible materials created
By SABRINA as art of its services under this Agreement shall he owned by SABRINA.

UPS AND IMG FASHION TO DELIVER FASHION’S FUTURE
10 Emerging Designers from Around the World
To Be Featured at Olympus Fashion Week
Calling all new fashion designers! UPS and IMG Fashion today announced they are accepting applications worldwide for 10 emerging designers to show their Spring 2007 collections at Olympus Fashion Week in New York City from Sept. 8-15.
The selected designers will show onsite in the UPS Hub, a venue constructed exclusively for the global shipping company in the famed Bryant Park tents. UPS launched the “UPS Delivers Fashion’s Future†initiative in September 2005 by featuring collections by Doo Ri, Project Alabama, Willow and Tomer, among others.
Designers are required to have been in business for at least two years and to have sold a minimum of two collections to a variety of boutiques and department stores. The 10 designers will be selected by a panel composed of key domestic and international fashion editors, retailers and industry professionals. These emerging designers will have their venue rental subsidized by UPS, which includes state-of-the-art lighting, sound and staging and inclusion in all Olympus Fashion Week collateral materials, marketing, public relations and advertising. They also will benefit from special collateral and marketing materials developed specifically by UPS for this initiative.
