I have a question regarding a deposition. I am being sued by a facilty in Nevada for libel/slander. They cannot prove their case, but have not yet dropped the suit. They have sent me a letter that says I am required to appear for a deposition. Now....they are in las vegas, nevada and I am in Montana. it is a 2 day, 1700 miles roundtrip, plus hotel, gas, food etc. If I fly down and rent a car it is still going to cost about $450.00 I have asked for the deposition to be held here in montana as it is an undue burden and hardship with the 2 day trip just to get there. The plantiff refused the written or phone deposition stating "unless I change my website info, I will bear the burden of expense". (they are mentioned on a memorial site, but it is all true and can be backed up with their own records and statements that I have)
So, my question is:
1. am I required to attend an out of state deposition? 2. Is it my expense to appear at their deposition when they refused a phone or written deposition in my own state? 3. can I ask for compensation for having to travel out of state at their request?
they will eventually lose the case as they cannot back up their suit, but until then they are trying to make it hard on myself and my family.
I have read that witnesses are intitled to fees, but I cant find anything out about out of state defendents.
Most of the lawyers I have talked to say that it is the plantiffs responsibilty of expense, but as all states are different, they did not know what Nevadas rules were.
