As a legal blogger when you type your name into Google your name should appear first or at least on the first page.
Is it true that first position or first page can only happen if you blog or comment on someone elses blog everyday?

No that is not necessarily true. I just 'Googled' "Karel Frielink" and your blog came first right away. You don't post every day on your blog.
A different story might be besides your name what other search terms are relevant if you want people to find your blog.
I shifted my blog to terapad:

Terapad,offers me a good insight into visitor behavior and it seems that there is a direct link between a post and visitor numbers. This in turn will most likely affect your rankings.
Posting comments on others' blogs can be helpful especially if combined with an INBOUND link to your own blog.
Furthermore, I learned from my 'blogger' times that registering your blog with search engines and blog search engines is really helpful. My old blog: http://nzpi.blogspot.com ranked number one when I searched my sir name but also when I'd use search terms such as investigator New Zealand. I was not a regular (read daily) blogger at that time at all.
Posting does help of course but it can be a time consuming thing. That's why I'd prefer search engine optimisation , blog pings and registering to as many search engines and directories as possible.
I'm not an expert but just sharing my thoughts and experiences.
Finally, check out Terapad, at http://www.terapad.com, he blogs are for free and they offer the most comprehensive package I have ever seen, including: the possibility to upload pages, run a forum, an online shop, a gallery, stats, career opportunity advertisements, 2 gigabite of storage space, and more. All for free. And for $5.00 a month the already subtle google adsense advertisements are away as well should you prefer this with 20 gig of added bandwidth a month extra.
And of course have a browse around on my new blogs. I started both on 10 January 2007 and have had a combined and equally divided number of 14000 visitors since then, without too much efforts. That is almost double than I ever had on my old blogs in all years combined (Since April 2005).
