I am associated with a recruitment/ placement firm specialising in advertising - I would like to know if there is a norm to have candidate exclusivity agreements in this field - Is it possible to have a candidate sign an exclusive representation agreement prior to placing them on a job so that the employer does not cut the recruiter out of the loop? How does one safe guard ones self if such an agreement is not in place - especially in cases where the employer can ask for a free lancer and then convert the candidate to be permanent without keeping the recruiter in the loop.

Appreciate all the feedback. If there is such an agreement possible, anyone can help with such a draft.

This is an important issue which does strike recruiting companies while trying to get into a new clients account.

Let me be upfront and say that under the current legal system irrespective of what agreements one may have the client is in a commanding position on these issues.

The best policy and safeguard on this is to undertake a due deligence on the client prior to taking up the assignment. We have had instances where despite agreements to pay the client has refused to pay the fees on flimsy grounds and even cases where they have paid promptly even when the agreement was not signed.

Better to be safe than sorry - no agreements work in such a situation - its all about credibility of the client in question.
