I think the game would need to be patented .... and you'd need a filing in India as well as in US and Europe for worldwide protection ....
If you're planning to talk to people for distribution and can't really afford to patent at this stage, do it under a Non Competition & Non Circumvention & Non Utilisation Agreement which is much wider in scope than a normal Non Disclosure Agreement .... http://OutSourcedCFO.GooglePages.Com
