Mohammed Afzal Guru, 35, hailing from North Kashmir has been sentenced to death by hanging for conspiring to attack the Indian Parliament on December 13, 2001. He is presently lodged at Tihar Jail and awaits execution on October 20, 2006. The Supreme Court has noted that there is no direct evidence of his involvement or of him belonging to any terrorist outfit. He has been convicted and sentenced to death purely on the basis of circumstantial evidence. A fortnight is too short a time for the President to consider the Clemency plea. So for the time being, it is required that the President put a stay on the execution of death penalty, to give Mohammed Afzal a fair chance. Judicial error cannot be ruled out just the same way as execution cannot be reversed. It is high time that the legal system focuses on the abolition of the death penalty and recognizes the basic right to life of every individual. Capital Punishment defers all theories of punishment, in no way being deterrent and must be abolished from our legal system. We strongly condemn the death penalty issued to Mohammed Afzal for his role in the attack on the Indian Parliament in 2001. We appeal to the President to issue pardon and commute the death penalty into life imprisonment.
