Registration of DocumentsViews: 747
Jul 31, 2008 6:54 amRegistration of Documents#

Ritu
While teaching Business Laws I come across certain sections where registration of certain documents is required.

For instance

Section 25 of the Indian Contract Act which says lays down exceptions to the rule no consideration no contract...a contract without consideration is void unless
'it is expressed in writing and registered under the law for the time being in force for the registration of [documents], and is made on account of natural love and affection between parties standing in a, near relation to each other.

Where & with whom such documents are required to be registered??
Where is a 'will' supposed to be registered??
Where is a partnership deed registered? Is there any registrar of partnerships like a Registrar of companies??

Thanks

All Registrations are done at the office of the Registrar of Assurances or the Sub-Registrar of Assurance (as the case may be) having jurisdiction over where the Executant or the subject matter of the deed is sitaute. Partnership Deeds and Trust Deeds are also registered with this office. However, in addition, Partnerships, Trusts, Societies, etc. have a separate Registration Office, where they have to be registered.

Please see Section 17 of the Registration Act to have a better idea of what Documents are compulsorily registrable.

The Registrar of Assurances (or Sub-Registrar as the case may be) have jurisdiction over a specified area as prescribed by the Government and all such dealings concerning properties situated within the said area have to be registered with the specified Registrar (Sub-Registrar)

The office can either be in a Court building or otherwise and it largely depends upon the availability of space and it varies from state to state.

For finding the exact location of an office you will have to make location specific query.

As far as my knowledge goes, Registration revenue and management is a State subject. There can be a number of Regsitries in a District depending on how big a District is. One can find details/addresses of Registries on the official websites of States.

Hey thanks Rikky & Vijay, but despite the best advice, intention & efforts the offices of Registrar of Assurance for M.P. remains elusive...(tried googling but no joy)...so when I introduce the topic in my class next week I'm gonna just tell that the registration is required to be done at Registrar of Assurance & leave it at that.

Dont be disheartened Ritu.
I did tell you that Registrar's offices are District-wise set up. Since you are from Indore, here are the details for Indore. Similarly, you can get for rest of MP also.

Thanks a bunch Vijay!...& just in time too...have to be in the class in 15 mins to take up this topic...indeed I was a bit disheartened cos my position was like a consultant who is defined as a guy who knows 99 positions of sex but not a single woman...I could wax eloquent about the necessity to get the documents registered but no idea where??....at the same time never underestimate the power of Govt sites to let one down...the site provides a link which says you can download a pdf file ..when you download you get a word file which doesn't open anyways....but I've got my info as circumstantial evidence at the site makes it clear that the offices for registration are at Collectorate....thanx a bunch for sparing so much time for my query.
