Hi All,

I m having our National Anthem 'Jana gana Mana' as my ring tone in my mobile which was sung by niece a 4 year old kid.

Few of my colleagues are saying that it is offense to have National Anthem as ring tone.

Kindly advice!

National Anthem, like the National Flag, can be played or cause to be played by any Indian as its a fundamental right of course subject to the duties attached. First and foremost is that the respect and dignity should be maintained. That is how precedents on the issue by many courts postulate.

The Vishwa Hindu Parishad had called for a ban on the national anthem ringtone in 2005, stating that it is offensive. "This is an insult to the national anthem and the ringtone should be banned immediately,'' they said, adding the service providers should strictly be asked to withdraw the ringtone." But as far as I know nothing was done by the courts in this case....but if we are required to stand still when National Anthem is playing...how will you move to pick the phone?? Problem of logistics here, eh??

In any case in India the use of National Flag & Anthem are very hypersensitive matters.

But the question is, does the use of National Anthem as ringtones constitute respect or disrespect?? The person using such ringtones must be very patriotic afterall...
what constitutes respect lies in the eyes of beholder...Narayan Murthy was at receiving end of loads of criticism when he decided not to play the National Anthem in presence of the President in Infosys Campus as 'it would make foreigners uncomfortable'!! (now how he arrived at such bizzarre logic is beyond me).. not playing the National Anthem is more disrespectful than showing interest in playing it.

The person who uses National Anthem ringtone really respects it, beyond doubt. Infact it is a patriotic act from that individual!

Law may say that the usage of Jana Gana Mana ringtone as offence...Can any judge come to a conclusion that such person is not patriotic? or anti-National? (i am reminded of one incident - A cake was made with Indian Flag pattern and was cut & distributed in the presence of high officials.. and the court termed it as offense!! lol. Poor patriotic indians. My Grandma used to say this is Kaliyug, and 'nallathukku kaalamillai' in Tamil (meaning:- 'doing things with good intention yields bad results')

Then, the one who uses Jana Gana Mana ringtone is a terorist? But our government is negotiating with terrorists!! lol..what a country! mera bharath mahan! :)

Our system is still allowing Afzals to survive while punishing innocent people!

Therefore, one must understand that using the National Anthem for a ring tone as a mark of respect and patriotism, is a right of every citizen, at the same time a duty is also bestowed, where the person should know when and in what situation he should not permit his cellphone to play the national anthem.

Adlabs has started a laudable effort. Lata and Asha come on the screen rendering the National Anthem before every show starts. I have seen everyone immediately stand up as a mark of respect. Many hold their palms to their heart, almost all sing along.

But, there are surely a few who choose to sit and dont stand up even when coaxed by their friends, rather they ridicule the whole effort. One who uses the National Anthem should guard it against such ridicule and disrespect.

The Grih Vibhag of the Grih Mantralaya is the jurisdiction defining body for this.

http://india.gov.in/myindia/images/jan.mp3 is the official downloadable for the National Anthem.

Regarding the interpretation of orders ( http://india.gov.in/images/new_orders.pdf ) one should ask
the PS to HS, of Grih Mantralaya to identify the proper officer for answering the query.
