Mohan Viswanathan | | An employee of the bank committed misappropriation and died. customers are approaching consumer court terming the misappropriation committed by the employee and consequent non settlement of their claims as deficiency of service by the bank and claiming the amount misappropriated with compensation for deficiency of service. Manish Paliwal | | Yes the consumer court has the jurisdiction if the misappropriation has been done during the course of employment. Before approaching the court you can also approach the ombudsman mechanism of bank. Probably it will be more convenient for you. Private Reply to Manish Paliwal |

RVIyengar | | Approaching the Banking Ombudsman (appointed by the RBI) would be the right thing to do, as the case involves complaint against deficiency in banking services. As the provision in this regard envisages, the banking ombudsman has the power to summon both the bank and the aggrieved customers to resolve the dispute through mediation.Private Reply to RVIyengar |

charuhasan | | Bank is an institution to serve a customer. It is not exempted from liability before a Consumer Forum. I had myself filed a case and got an order fining the bank to pay five thousand for delay in payment of amount due under a demand draft. Vicarious liability is recognized by all contracts.
